1. Users of the Service

The Service is provided exclusively to individuals who are at least 18 years of age. By using FeelSparked, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

The Service is provided exclusively to real persons. Accounts registered by "bots" or automated methods are not authorized and will be terminated immediately.

Each user is solely responsible for all actions performed through the Service and their Account.

2. Authorized Use of the Service

You agree not to use your Account or the Service for any illegal or prohibited activities. Unauthorized activities include, but are not limited to:

• Disrupting FeelSparked's networks and servers in your use of the Service
• Accessing, sharing, downloading, or uploading illegal content, including but not limited to Child Sexual Abuse Material (CSAM) or content related to CSAM
• Infringing upon or violating the intellectual property rights of FeelSparked or a third party
• Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating, or discriminating against someone based on gender, sexual orientation, religion, ethnicity, race, age, nationality, or disability
• Trading, selling, or otherwise transferring the ownership of an Account to a third party
• Promoting illegal activities or providing instructional information to commit illegal activities
• Having multiple free Accounts (creating bulk signups or operating a large number of free Accounts)
• Paying for your subscription with fraudulent payment means, such as a stolen credit card
• Engaging in spam activities, which includes sending irrelevant or unsolicited messages
• Using a free account for the purpose of creating fake profiles or soliciting users
• Attempting to access, probe, or connect to computing devices without proper authorization

Any Account found to be committing any of the listed unauthorized activities will be immediately suspended or terminated. FeelSparked may also terminate Accounts which are being used for illegal activities, particularly in response to orders from competent authorities.

We reserve the right to limit service capacity for free Accounts which use excessive resources and hurt the user experience of other users.

3. Inactive Accounts

FeelSparked reserves the right to suspend or delete free Accounts that have been inactive for a consecutive period of 12 months.

If you have been inactive on your free Account for 12 months or more, access to your Account and all associated data (including messages, photos, and profile information) may be deleted. You will receive notices 30, 15, and 7 days in advance before such action is taken.

Accounts under an active paid subscription are always considered active. You are considered active by logging into your Account or using the Service at least once every 12 months.

4. Limited Warranties and Liability

FeelSparked does not make any warranty about the reliability of the Service or the security of user data, despite best efforts. The Service is provided "as is" and "as available," without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, accuracy, non-infringement, or warranties that may arise from course of dealing or course of performance or usage of trade.

FeelSparked has no obligation to store or forward the contents of terminated Accounts. We also have no obligation to store messages or contents for accounts that exceed their storage quotas. Furthermore, you will not hold FeelSparked liable if confidential material is unintentionally released as the result of a security failure or if data is deleted for an inactive account. Due to the encrypted nature of the Service, you acknowledge that FeelSparked has no ability or obligation to recover your data if you misplace your password.

To the extent not prohibited by law, you acknowledge and agree that in no event will FeelSparked be responsible or liable to you or any third party for any indirect, special, exemplary, incidental, consequential, or punitive damages, whether arising at law, in equity, or otherwise, even if we have been advised of the possibility of such damage.

Without limitation of the foregoing, the total liability of FeelSparked for any reason whatsoever shall not exceed $100, or the amount you paid us, if any, whichever amount is greater.

5. Privacy

Our Privacy Policy explains how we handle and protect your personal data. By agreeing to these Terms, you also agree to our Privacy Policy.

6. Intellectual Property

All trademarks, service marks, logos, trade names, and other proprietary designations of FeelSparked are trademarks of the Company. Nothing in these Terms should be construed as granting any license to use any of the FeelSparked trademarks without our prior written permission.

7. Terms of Payment

Subscriptions for the Service are charged on a monthly, quarterly, or annual billing cycle, depending on your selection. After the initial term, the subscription is renewed automatically for the duration specified during your initial purchase, unless cancelled by you. You are responsible for keeping payment information up to date.

You may cancel your subscription within 30 days of the initial purchase and receive a refund for any unused portion of the service period. To request a refund, please contact our support. Payments made by cash or bank transfers are not refundable. Refunds can only be requested once per user.

Past the 30-day period, the Service is non-refundable and any refund given will be at the sole discretion of FeelSparked. Paid Accounts terminated due to a violation of these Terms will incur the loss of all payments and are not eligible for refund.

If you fail to fulfill your payment obligation, your account may be automatically downgraded to a Free account. If your Account exceeds the limits of our free tier after the downgrade, your Account will be put in a restricted state.

Subscriptions and credits are linked to the Account they were purchased for and cannot be transferred to another account.

8. Modification of Plan or Billing Cycle

If you select a new paid plan, your subscription will be immediately updated, and you will receive a prorated credit for the unused portion of your previous plan.

If you do not want your plan to renew, you need to downgrade your plan before the end of your subscription period. If you downgrade before the end of your subscription period, we will provide you with an Account credit for the unused portion of your subscription.

9. Modification to the Terms of Service

Within the limits of applicable law, FeelSparked reserves the right to review and change these Terms at any time. Continued use of your Account or the Service after such changes constitutes your consent to them.

10. Severability

If any provision of these Terms is held to be void or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms shall remain in full force and effect.

11. Applicable Law

These Terms shall be governed by the substantive laws of Switzerland, to the maximum extent permitted by law. Any disputes shall be subject to the jurisdiction of the competent courts of the Canton of Geneva.

12. Miscellaneous

These Terms do not affect your statutory rights or your legal rights, if any, as a consumer.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

These Terms represent the entire agreement between you and us in connection with your use of the Service.

1. Our Privacy Commitment

At FeelSparked, your privacy is not negotiable. We do NOT sell your data. We do NOT spy on you. We do NOT use your information for advertising. We do NOT share your information with third parties.

Your conversations are your business. We built FeelSparked with zero-knowledge encryption, which means even we cannot read your messages. This is not a feature - it's our foundation.

2. Zero-Knowledge Encryption: What This Means for You

When you send a message on FeelSparked, something unique happens:

• Your Password is the Key: When you log in, your password creates a master encryption key in your device's memory (RAM). This key encrypts all conversation keys before they're sent to our servers. The master key only exists while you're logged in and is destroyed when you log out.
• Messages Encrypted Before Sending: Every message you send is encrypted on your device using military-grade AES-256-GCM encryption before it reaches our servers.
• We Store Encrypted Keys: Our servers store conversation keys, but they're encrypted with your master key. Without your password, these encrypted keys are useless - we cannot decrypt them.
• True Privacy: Not even FeelSparked employees, administrators, or founders can decrypt your message keys or read your messages. Your password is the only way to unlock your data.
• The Trade-Off: If you forget your password and lose your recovery code, your data is permanently inaccessible. We cannot recover it because we cannot decrypt it. This is intentional.

3. Information We Collect and Why

Account Information (Required for Basic Functionality):

• Email Address: Used solely for account verification, password recovery, and critical security notifications. We never send marketing emails.
• Password: Hashed using bcrypt before storage. We never see or store your actual password. Your password creates your encryption key on login, then is immediately discarded from memory.
• Date of Birth: Required to verify you are 18 or older. We are legally required to ensure all users are adults.
• Recovery Code: A unique code provided once during signup. This is your backup if you forget your password. We store it hashed (encrypted) so even we cannot see it.

Profile Information (What You Choose to Share):

• Name, photos, bio, interests, and preferences you add to your profile
• Your profile is visible to other users for matching purposes
• You control what appears on your profile and can edit or delete it anytime

Usage Information (Minimal and Anonymous):

• Basic connection data (when you log in, what features you use) to keep the app running smoothly
• Error logs to fix bugs and improve performance
• This data is not tied to your identity and is not shared with anyone

4. What We Absolutely DO NOT Collect

• ❌ No Ad Tracking: No tracking pixels, no ad cookies, no behavioral profiling
• ❌ No Location Tracking: We don't track your precise location or movements
• ❌ No Browsing History: We don't monitor what you do outside FeelSparked
• ❌ No Device Fingerprinting: We don't create unique device IDs to track you
• ❌ No Social Media Connections: We don't scrape your social media or contacts
• ❌ No Message Content: We cannot read your messages due to zero-knowledge encryption

5. How We Handle Reports and Safety

While we cannot read your messages, we take safety seriously:

• Users can report inappropriate behavior by submitting screenshots or descriptions
• We review user-submitted evidence (not your private messages)
• Accounts violating our Terms of Service are banned immediately
• We may be required by law to assist law enforcement with valid legal requests, but we can only provide the encrypted data we have - we cannot decrypt your messages

6. Your Data Rights

You have complete control over your data:

• Access: Download a copy of all your data at any time from your account settings
• Correction: Edit your profile, photos, and information whenever you want
• Deletion: Delete your account permanently. All your data is removed from our systems within 30 days. Due to encryption, deleted data cannot be recovered.
• Portability: Export your data in a standard format to use elsewhere

7. How We Protect Your Data

• Zero-Knowledge Encryption: Your password creates encryption keys that exist only in your device's memory
• AES-256-GCM Encryption: Military-grade encryption for all messages and sensitive data
• HTTPS/TLS: All connections between your device and our servers are encrypted in transit
• Secure Password Hashing: Passwords hashed with bcrypt (industry standard)
• Regular Security Audits: We continuously monitor and improve our security practices

8. Children's Privacy

FeelSparked is strictly for users 18 years and older. We do not knowingly collect information from anyone under 18. If we discover an underage user, their account is immediately deleted.
